Please read these Terms and Conditions ("Terms") carefully before using the Heartache Network website, Discord server, or any associated Minecraft game servers (collectively, the "Services").
By accessing or using any of our Services, you signify your agreement to be bound by these Terms and our official Rules (available at https://heartache.network/rules). If you do not agree to these Terms or our Rules, you are prohibited from using our Services.
"We," "Us," "Our": Refers to the owner(s) and staff of Heartache Network.
"You," "User," "Player": Refers to any individual accessing the Services.
"Store": Refers to our official webstore (store.heartache.network) operated via CraftingStore.
"Gift Page": Refers to our separate page for voluntary monetary support.
"Virtual Items": Refers to any digital items, currency, ranks, perks (such as unbans or reduced death timers), or cosmetics for use within the Services.
You are solely responsible for the security of your Minecraft account and Discord account. We are not responsible for any unauthorised access to your account, nor are we liable for any items, ranks, or progress lost due to a compromised account.
All users must adhere to our official rules, which are published at https://heartache.network/rules. These rules are a core part of these Terms. Failure to comply with these rules will result in punishments, including but not limited to mutes, temporary bans, and permanent bans from all Services.
This section governs all purchases made through our official Store.
No Refunds: All sales are final. We do not offer refunds for any virtual items or services. As you are purchasing a license for digital goods that are delivered instantly, you waive any right to a "cooling-off" period.
Chargebacks: Initiating a chargeback or payment dispute for any purchase will result in an immediate, permanent, and irreversible ban from our entire network (all game servers, the website, and the Discord).
No Guarantee of Service: We reserve the right to change, modify, or remove any virtual items, ranks, or perks at any time, with or without notice. A purchase does not guarantee the continuous availability of a specific item.
Virtual Items Have No Monetary Value: All virtual items are a non-transferable license to use a feature on our server and hold no real-world cash value. We do not offer "cash-outs" for any in-game items or currency.
Bans: If you are banned from our Services for violating our rules (see Section 3), you will not be eligible for a refund on any purchases made.
Our Services may include a "Gift Page" separate from the Store.
This is Not a Purchase: Any funds sent through this page are a voluntary, non-refundable gift to the server owner(s) to show appreciation.
No Goods in Return: By using the Gift Page, you acknowledge that you will receive no goods, items, perks, services, or any other benefits (material or immaterial) in exchange for your gift.
We reserve the right to terminate or suspend your access to our Services (i.e., ban you) at any time, for any reason, including for a breach of these Terms or the Server Rules, with or without notice.
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the Services will be uninterrupted, secure, or error-free. We are not liable for any data loss, including but not limited to the loss of your player inventory, in-game progress, builds, or virtual items, which may occur due to server crashes, resets, or other events.
By using our Services, you affirm that you are at least 18 years old, or you have obtained explicit permission from a parent or legal guardian. Your parent or guardian agrees to be bound by these Terms on your behalf. All purchases or gifts must be made by an individual 18 years or older, or with the direct involvement and permission of a parent or guardian.
In no event shall Heartache Network, its owners, or its staff be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Services.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via an announcement on our Discord or Website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
